1. Verantwortlicher
Verantwortlich für die Datenverarbeitung in dieser App ist der im Impressum genannte Betreiber von Trackly.
2. Welche Daten wir verarbeiten
Je nach Nutzung verarbeiten wir: Kontodaten (E-Mail-Adresse, Anzeigename), Ernährungs- und Fitnessdaten (Mahlzeiten, Kalorien, Makronährstoffe, Gewicht, Wasserzufuhr, Trainingseinträge, Streak-Verlauf), von dir hochgeladene Essensfotos zur automatischen Analyse sowie technische Nutzungsdaten.
Ernährungs- und Gewichtsdaten können Rückschlüsse auf deine Gesundheit zulassen. Wir behandeln sie mit besonderer Sorgfalt und geben sie nicht zu Werbezwecken an Dritte weiter.
3. Zwecke und Rechtsgrundlagen
Wir verarbeiten deine Daten zur Bereitstellung der App-Funktionen und zur Abwicklung deines Abonnements (Art. 6 Abs. 1 lit. b DSGVO) sowie, soweit du eingewilligt hast, zur Verbesserung der App (Art. 6 Abs. 1 lit. a DSGVO).
4. Eingesetzte Dienstleister
Firebase (Google Ireland Ltd.) — Authentifizierung, Datenbank und Server-Funktionen.
Google Gemini API — automatische Erkennung von Kalorien und Makronährstoffen auf hochgeladenen Essensfotos.
Stripe — Zahlungsabwicklung für Abonnements. Kartendaten werden ausschließlich von Stripe verarbeitet.
RevenueCat — Verwaltung und Validierung von Abonnements.
PostHog Inc. — Produktanalyse (z. B. welche Funktionen genutzt werden und an welcher Stelle Nutzer die App verlassen) sowie anonymisierte Sitzungsaufzeichnungen zur Verbesserung der App. Eingaben und Textinhalte werden dabei maskiert und nicht im Klartext aufgezeichnet.
Diese Dienstleister können Daten auch außerhalb der EU (u. a. in den USA) verarbeiten; die Anbieter sind vertraglich zur Einhaltung eines europäischen Datenschutzniveaus verpflichtet (z. B. EU-US Data Privacy Framework oder Standardvertragsklauseln).
5. Speicherdauer
Wir speichern deine Daten, solange dein Konto besteht. Nach Löschung deines Kontos werden deine Daten innerhalb einer angemessenen Frist gelöscht, soweit keine gesetzlichen Aufbewahrungspflichten entgegenstehen.
6. Deine Rechte
Du hast das Recht auf Auskunft, Berichtigung, Löschung und Einschränkung der Verarbeitung deiner Daten, ein Recht auf Datenübertragbarkeit sowie ein Widerspruchsrecht gegen bestimmte Verarbeitungen. Du kannst dich jederzeit bei einer Datenschutz-Aufsichtsbehörde beschweren.

8. Warteliste (diese Seite)
Wenn du dich auf dieser Seite in die Warteliste einträgst, speichern wir deine E-Mail-Adresse, den Zeitpunkt, die Herkunft des Aufrufs (zum Beispiel ein Link aus TikTok oder Instagram), die im Browser eingestellte Sprache, einen zufälligen Code für die Anzeige deines Platzes sowie den Stand der Bestätigung.
Wir nutzen diese Daten, um dir eine Mail mit einem Bestätigungslink zu schicken (Double-Opt-in), dich per Mail zu benachrichtigen, sobald Trackly startet, und um zu sehen, wie groß das Interesse ist. Rechtsgrundlage ist deine Einwilligung (Art. 6 Abs. 1 lit. a DSGVO). Du kannst sie jederzeit widerrufen: eine formlose E-Mail an die im Impressum genannte Adresse genügt, dann löschen wir deinen Eintrag. Spätestens zwölf Monate nach dem Start von Trackly löschen wir die Liste.
Gespeichert wird in der Firebase Realtime Database (Google) in der Region europe-west1 (Belgien). Die Liste ist von außen nicht lesbar. Für den Versand der E-Mails nutzen wir Resend (Resend, Inc., USA) als Auftragsverarbeiter. Dorthin übertragen wir deine E-Mail-Adresse, nach deiner Bestätigung auch als Kontakt für die Start-Mail.
Sobald du in das E-Mail-Feld tippst, laden wir den Datenbank-Baustein von www.gstatic.com (Google); dabei erfährt Google deine IP-Adresse. Wir laden ihn deshalb erst dann und nicht schon beim Aufruf der Seite. Die Seite selbst wird über Firebase Hosting (Google) ausgeliefert, dabei verarbeitet Google technisch notwendige Zugriffsdaten wie deine IP-Adresse. Die Schriften (Inter, Archivo) liegen auf unserem eigenen Server, es gibt keine Verbindung zu Google Fonts. Diese Seite setzt keine Cookies und bindet keine Analyse- oder Werbewerkzeuge ein.
Die Links zu TikTok und Instagram sind einfache Links ohne eingebettete Inhalte; erst ein Klick überträgt etwas an diese Anbieter.

The controller for data processing in this app is the operator of Trackly named in the imprint.
2. Which data we process
Depending on how you use it, we process: account data (email address, display name), nutrition and fitness data (meals, calories, macronutrients, weight, water intake, workout entries, streak history), food photos you upload for automatic analysis, and technical usage data.
Nutrition and weight data can reveal information about your health. We treat it with particular care and do not pass it on to third parties for advertising purposes.
3. Purposes and legal bases
We process your data to provide the app's functions and to handle your subscription (Art. 6(1)(b) GDPR) and, where you have consented, to improve the app (Art. 6(1)(a) GDPR).
4. Service providers we use
Firebase (Google Ireland Ltd.) — authentication, database and server functions.
Google Gemini API — automatic recognition of calories and macronutrients in uploaded food photos.
Stripe — payment processing for subscriptions. Card data is processed exclusively by Stripe.
RevenueCat — management and validation of subscriptions.
PostHog Inc. — product analytics (e.g. which features are used and where users leave the app) and anonymized session recordings to improve the app. Inputs and text content are masked and not recorded in plain text.
These providers may also process data outside the EU (including in the USA); they are contractually bound to a European level of data protection (e.g. the EU-US Data Privacy Framework or standard contractual clauses).
5. Retention
We store your data for as long as your account exists. After you delete your account, your data is deleted within a reasonable period, unless statutory retention obligations apply.
6. Your rights
You have the right to access, rectification, erasure and restriction of processing of your data, the right to data portability, and the right to object to certain processing. You can lodge a complaint with a data protection supervisory authority at any time.

8. Waitlist (this website)
When you join the waitlist on this page, we store your email address, the time of signup, the source of your visit (for example a link from TikTok or Instagram), the language set in your browser, a random code used to show you your place, and the status of your confirmation.
We use this data to send you an email with a confirmation link (double opt-in), to notify you by email as soon as Trackly launches, and to see how much interest there is. The legal basis is your consent (Art. 6(1)(a) GDPR). You can withdraw it at any time: an informal email to the address in the imprint is enough, and we will delete your entry. We delete the list no later than twelve months after Trackly launches.
The data is stored in the Firebase Realtime Database (Google) in the region europe-west1 (Belgium). The list cannot be read from outside. To send emails we use Resend (Resend, Inc., USA) as a processor. We transfer your email address to Resend, and after you confirm, also as a contact for the launch email.
As soon as you type into the email field, we load the database component from www.gstatic.com (Google); Google then learns your IP address. This is why we load it only at that point and not when the page opens. The page itself is delivered through Firebase Hosting (Google), which processes technically necessary access data such as your IP address. The fonts (Inter, Archivo) are served from our own server; there is no connection to Google Fonts. This page sets no cookies and includes no analytics or advertising tools.
The links to TikTok and Instagram are plain links without embedded content; data is only transferred to these providers once you click one.
